Fossil hunting is an outdoor activity that can be dangerous to individuals if they are not careful. At a fossil collecting site, injury to an individual, including serious injury, could result from many things such as vehicular traffic, rough or uneven terrain, slippery mud, sharp rocks or broken glass and other natural obstacles. No attempt has been made by Dry Dredgers, Inc. or any of its members to locate, remove or otherwise reduce any hazards of the collection site. EACH INDIVIDUAL AT THE COLLECTION SITE MUST WATCH OUT FOR THEIR OWN SAFETY AND EACH INDIVIDUAL SHALL BE RESPONSIBLE FOR THEIR OWN SAFETY AND EACH INDIVIDUAL SHALL NOT RELY ON ANY OTHER PERSON TO DO THIS FOR THEM. IF YOU HAVE BROUGHT CHILDREN TO THE COLLECTING SITE, YOU MUST WATCH OUT FOR THESE CHILDREN’S SAFETY AND YOU SHALL BE RESPONSIBLE FOR THE SAFETY OF THE CHILDREN YOU BROUGHT WITH YOU AND YOU SHALL NOT RELY ON ANY OTHER PERSON TO DO THIS FOR THE CHILDREN YOU BROUGHT WITH YOU.
Dry Dredgers, Inc. is an Ohio not-for-profit corporation. In this document Dry Dredgers, Inc. may be referred to as "Club" or "the Club". "Officer(s)"is a duly elected or appointed officer of the Club. "Member(s)" is any person who is currently carried on the membership roles of the Club. "Guest(s)" is any person who is not a Member.
The Club, its officers and Members, shall not be liable for any damages arising from damage to personal property or personal injuries sustained by Members attending Club activities or programs, or any Guests attending Club activities or programs or while enrolled or participating in the Club's activities or programs and each individual Member or Guest does so at his or her own risk.
In consideration for being able to participate in any Club activity or program, A Member or Guest agrees to assume full responsibility for any injuries or damages which may occur to the Member or Guest in the course of such programs and activities. In addition, the Member or Guest does hereby fully and forever release and discharge the Club, its officers and Members, from any and all claims, demands, damages, rights of action, or causes of action, present or future, whether the same be known or unknown, anticipated or unanticipated, resulting from or arising out of the Member’s or Guest’s participation in programs and activities, including from or arising out of the negligence of the Club, its Officers or Members or any other persons present at said programs or activities. Each Member or Guest agrees that they (the Member or Guest) shall pay the full cost of any legal defense that the Club, it Officers or any other Member incurs in defense of any claim that such Member or Guest might bring in contravention of this release without regard to the merits of such Member’s or Guest’s claim.
By my signature below, I acknowledge that:
1. I have read the warning concerning the dangers of fossil collecting set out above, and;
2. I have read the terms of the liability release set out above and agree to be bound by the terms of the release, and;
3. I have been provided with a copy of the warning and release set above that I may retain.
